BOE Marine Invoice Terms & Conditions

Effective Date: 1/1/2026

Last Updated: 5/6/2026

These Invoice Terms & Conditions apply to invoices, estimates, service work, product sales, installations, storage, and related transactions with Yachts By Owner Inc. d/b/a BOE Marine, a Maryland corporation, located at 325 Cleat St, Stevensville, MD 21666.

By approving an estimate, paying an invoice, authorizing a payment method, placing an order, leaving a Boat/RV or other property with BOE Marine, or otherwise proceeding with BOE Marine products or services, the customer, vessel owner, RV owner, account holder, or authorized representative agrees to these terms.

These terms supplement BOE Marine’s website Terms & Conditions available at www.boemarine.com/terms-and-conditions. In the event of a conflict between these Invoice Terms and BOE Marine’s website Terms & Conditions, the terms most specific to the transaction, invoice, service, storage, or authorization shall apply.

1. Customer Authorization

Customer represents that they are authorized to approve the work, purchase products, authorize payment, and make decisions regarding the Boat, RV, vessel, equipment, or property associated with the invoice.

By providing payment information, Customer represents and warrants that they are authorized to use the selected payment method. BOE Marine’s website terms also state that payment must be made using available payment methods and that customers represent they are authorized to use the payment method provided.

2. Estimates, Invoices, and Approval of Work

Estimates are based on information available at the time they are prepared and may change if additional parts, labor, diagnosis, freight, manufacturer changes, site conditions, vessel/RV access issues, or other factors arise.

BOE Marine may pause work or withhold completion, delivery, release, or additional services until required approvals, deposits, progress payments, or final payments are received.

Approval of an estimate, invoice, work order, authorization form, payment request, or written/email/text approval authorizes BOE Marine to proceed with the described work, order parts, charge approved deposits or balances, and perform related services.

3. Pricing, Product Information, and Errors

BOE Marine makes reasonable efforts to provide accurate pricing, product descriptions, availability, specifications, and estimates. However, pricing errors, typographical errors, manufacturer changes, discontinued items, freight changes, and product availability issues may occur.

BOE Marine reserves the right to correct pricing or product information errors and may cancel or refuse orders placed at an incorrect price, even if the order has been confirmed or payment processed. If payment has been processed for a cancelled order, BOE Marine will issue a refund to the original payment method. This mirrors BOE Marine’s public website terms on pricing errors and order cancellation.

4. Orders and Acceptance

All orders, including product orders, service orders, installation work, and special orders, are subject to acceptance by BOE Marine.

BOE Marine may refuse, cancel, or modify an order or service request due to product unavailability, pricing inaccuracies, suspected fraud, safety concerns, incomplete information, nonpayment, or other business reasons.

For product purchases through BOE Marine’s website, order confirmation does not signify final acceptance; acceptance occurs only upon shipment.

5. Payment Terms

Unless otherwise stated in writing, invoices are due upon receipt.

Customer agrees to pay all approved charges, including parts, labor, materials, diagnostic time, installation supplies, freight, shipping, storage, shop supplies, taxes, special order items, and other amounts shown on the invoice.

BOE Marine may require deposits, progress payments, or payment in full before ordering products, scheduling work, releasing property, shipping products, or completing delivery.

Customer authorizes BOE Marine to charge any payment method provided by Customer for approved invoices, deposits, balances, storage fees, service charges, and related amounts due.

6. Credit Card Authorization

By providing a credit card or other payment method to BOE Marine, Customer authorizes BOE Marine to charge that payment method for amounts owed, including invoices, deposits, approved work, parts, labor, storage charges, special orders, and any other agreed charges.

If a credit card is provided for recurring or ongoing charges, including storage, Customer authorizes BOE Marine to charge the card as charges become due.

Customer agrees not to dispute properly authorized charges and agrees to contact BOE Marine promptly with any billing concern before initiating a chargeback.

7. Shipping, Delivery, and Risk of Loss

Shipping and delivery dates are estimates only and are not guaranteed. BOE Marine is not responsible for delays caused by carriers, weather, manufacturers, suppliers, customs, freight companies, or circumstances beyond BOE Marine’s control. BOE Marine’s public terms also state that shipping estimates are for convenience only and that BOE Marine is not responsible for carrier, weather, or beyond-control delays.

For shipped product orders, risk of loss and title pass to Customer upon delivery to the carrier, consistent with BOE Marine’s website terms.

8. Returns and Refunds

Returns and refunds are subject to BOE Marine’s stated return policies, including any time limits, product condition requirements, manufacturer restrictions, special order restrictions, and restocking or shipping limitations.

Installed, used, opened, special order, custom, electrical, programmed, modified, or otherwise non-resalable items may not be eligible for return unless BOE Marine agrees in writing.

9. Storage of Boats, RVs, and Customer Property

If Customer’s Boat, RV, vessel, trailer, equipment, or other property is stored at BOE Marine while work is being performed, or remains at BOE Marine before or after work, the following storage terms apply.

Storage is provided at 325 Cleat St, Stevensville, MD 21666. BOE Marine may revise the storage terms with one month advance notice to the Owner.

The storage term begins when the Boat/RV or other property arrives at BOE Marine and continues for as long as it remains on the property.

10. Storage Charges

There are no storage charges while the Boat/RV has an active BOE Marine service ticket and for seven days after completion of all open service tickets.

If the Boat/RV is not removed after that time, Owner shall pay storage charges equal to the lesser of:

$6.00 per foot per month, or

$10.00 per day.

Monthly storage is billed in advance on the first day of each month and is payable upon receipt. Partial months will be prorated to the lesser of $10.00 per day or $6.00 per foot per month.

All outstanding storage, service, parts, labor, and other charges must be paid in full before the Boat/RV or other property may leave BOE Marine’s storage yard.

If a credit card is on file, Owner authorizes BOE Marine to automatically charge storage fees at the beginning of each month.

11. Work on Boats/RVs While Stored

All normal maintenance or service work on Boats/RVs stored at BOE Marine shall be contracted through BOE Marine unless BOE Marine agrees otherwise.

Owners may board their Boats/RVs for cleaning only. Owners must provide their own OSHA-approved ladders and staging and agree to hold BOE Marine harmless from any liability arising from the Owner’s use of the premises, including entering, cleaning, or performing any activity on or around the Boat/RV.

Owners may hire independent contractors only for work BOE Marine does not perform, and only if the contractor has been approved by BOE Marine to work in the yard and has a current certificate of insurance on file, including workers’ compensation coverage and general liability coverage with a minimum of $1,000,000 per occurrence.

12. Yard Rules and Safety

No electric cords may be left plugged in when the Boat/RV is vacated.

No smoking is permitted on any Boat/RV at any time while stored at BOE Marine.

BOE Marine tools and ladders will not be loaned. Owners must provide their own tools and ladders. Owners are not permitted inside the shop or garage portion of the building at 325 Cleat St, Stevensville, MD 21666.

No electric heaters, water heaters, open-flame heaters, or torches may be used on Boats/RVs at any time.

Electric sanders must be equipped with a vacuum to collect sanding dust. Tarps must be used to properly collect paint scrapings.

Owners are responsible for properly securing Boat/RV covers. Covers may not be tied to stands. Owners may be billed for any necessary re-securing of covers.

Customer agrees not to use the premises for any unlawful purpose or in violation of any ordinance, regulation, fire code, health code, or BOE Marine policy. Customer agrees not to leave trash or debris in or near the storage area.

13. Owner’s Risk of Loss; No Bailment

No bailment is created by these terms or by BOE Marine’s possession or storage of any Boat/RV or property.

The exclusive care, custody, and control of all Boats/RVs, vessels, trailers, equipment, and personal property stored at BOE Marine remains with the Owner. All property is stored at Owner’s sole risk.

BOE Marine, its agents, and employees are not liable for loss of or damage to any Boat/RV or personal property, including loss or damage caused by burglary, theft, mysterious disappearance, fire, water damage, rodents, weather, Acts of God, or the active or passive acts, omissions, or negligence of Owner, Owner’s agents, contractors, guests, or invitees.

Owner is responsible, at Owner’s expense, for maintaining insurance to protect Owner and Owner’s property against all risks. BOE Marine does not maintain insurance for the benefit of Boat/RV owners or customers covering any loss or claim.

Owner agrees to indemnify and hold BOE Marine harmless from any and all claims, damages, losses, property damage, personal injury, or related expenses arising out of Owner’s Boat/RV, property, contractors, guests, invitees, actions, omissions, or use of BOE Marine’s premises.

14. Right to Move Property

BOE Marine reserves the right to move any Boat/RV, vessel, trailer, mast, equipment, or personal property within the premises of 325 Cleat St, Stevensville, MD 21666 without prior notice to Owner.

Boats/RVs, masts, trailers, and personal property must remain in moveable condition at all times.

15. Limitation of Liability

To the fullest extent permitted by law, BOE Marine shall not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to products, service work, installations, invoices, storage, website use, or purchases.

For product-related claims, BOE Marine’s website terms state that total liability shall not exceed the amount paid for the product at issue.

16. Customer Property and Personal Items

Customer is responsible for removing or securing valuables, electronics, personal items, gear, tools, documents, and other property before leaving any Boat/RV or other property with BOE Marine.

BOE Marine is not responsible for personal items left in or on any Boat/RV, vessel, trailer, vehicle, equipment, package, or other property.

17. Manufacturer Warranties

Products may be covered by manufacturer warranties. BOE Marine does not make separate manufacturer warranty promises unless expressly stated in writing.

Warranty coverage, warranty labor, diagnostic time, removal/reinstallation, shipping, and replacement decisions may be subject to manufacturer policies and approval.

18. Website Terms

Use of BOE Marine’s website and online purchases are also governed by BOE Marine’s website Terms & Conditions. Those terms cover website use, product information, pricing errors, order acceptance, payment, shipping and delivery, returns and refunds, limitation of liability, intellectual property, governing law, changes to terms, and contact information.

19. Governing Law and Venue

These terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.

Any disputes arising from or related to these terms, invoices, storage, service work, products, website use, or transactions with BOE Marine shall be resolved exclusively in the state or federal courts located in Maryland, and Customer consents to the jurisdiction of those courts. BOE Marine’s public website terms use the same Maryland governing law and venue framework.
